By accessing or using the MBPP Properties platform ("Platform"), you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform. These Terms constitute a legally binding agreement between you and Mutual Benefit Premier Properties Ltd.

MBPP Properties provides a digital real estate marketplace that connects property seekers with verified property listings across Kano State and Northern Nigeria. Our services include:

• Property browsing and search functionality
• Property listing and marketing services
• Tenant application processing
• Agent management and coordination
• Transaction facilitation between parties
• Easy Buy installment payment plans
• Property reservation services
• Digital agreement and documentation management

When creating an account on our Platform, you must provide accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing valid identification when required (NIN, BVN, or Voter's Card)

Mutual Benefit Premier Properties Ltd reserves the right to suspend or terminate accounts that violate these Terms or contain fraudulent information.

All property listings on the Platform must be accurate, truthful, and complete. Listing owners and agents are responsible for:

• Providing accurate property descriptions, photographs, and pricing
• Updating listings when properties become unavailable
• Ensuring compliance with the Land Use Act of Nigeria
• Verifying property ownership and title documents

Mutual Benefit Premier Properties Ltd reserves the right to remove any listing that violates these Terms, contains misleading information, or fails to meet our quality standards.

Registered agents on the Platform agree to:

• Represent properties truthfully and maintain client confidentiality
• Comply with the Nigeria Data Protection Regulation (NDPR)
• Provide valid identification (NIN or BVN) and professional references
• Adhere to the commission structure as agreed in their agent agreement
• Maintain professional conduct in all client interactions

Default commission rates are set at 5% of successful transaction values, unless otherwise negotiated in writing.

The Easy Buy program allows qualified buyers to purchase properties with a minimum 30% deposit and flexible installment payments over 3, 6, or 12 months. Key terms include:

• Initial deposit of 30% of the agreed cash purchase price
• Installment charges: +3% (3 months), +6.5% (6 months), or +14% (12 months)
• Property ownership transfers upon completion of all payments
• Default on payments may result in forfeiture of deposits as per the signed agreement

Property reservations are free and valid for 24 hours unless otherwise stated. Holding deposits may be required for extended reservations and are subject to the terms specified in the reservation agreement.

All payments on the Platform are processed securely through authorized payment providers. Mutual Benefit Premier Properties Ltd:

• Does not store payment card details on our servers
• Is not liable for payment disputes between buyers, sellers, landlords, or tenants
• Reserves the right to reverse fraudulent transactions
• Provides payment receipts for all successful transactions

Tenancy agreements facilitated through the Platform are subject to the Tenancy Law of Kano State. Both landlords and tenants are responsible for:

• Reviewing and understanding all agreement terms before signing
• Complying with the agreed rental terms and conditions
• Maintaining the property in accordance with the agreement
• Resolving disputes through the agreed arbitration process

All content on the Platform, including but not limited to text, graphics, logos, images, and software, is the property of Mutual Benefit Premier Properties Ltd or its licensors and is protected by Nigerian copyright law. Users may not reproduce, distribute, or create derivative works without written permission.

Users of the Platform agree not to:

• Post false, misleading, or fraudulent property listings
• Engage in discriminatory practices based on ethnicity, religion, or gender
• Use the Platform for money laundering or illegal financial activities
• Attempt to gain unauthorized access to other user accounts or Platform systems
• Use automated systems to scrape or collect data from the Platform
• Violate any applicable Nigerian laws or regulations

Mutual Benefit Premier Properties Ltd acts as a marketplace intermediary and is not liable for:

• The accuracy of property listings provided by third parties
• The outcome of transactions between users
• Property conditions, defects, or title issues
• Direct, indirect, incidental, or consequential damages

The Platform is provided "as is" without warranties of any kind, either express or implied.

While we strive to verify property listings, users are responsible for conducting their own due diligence before making any property decisions. This includes:

• Physical inspection of properties
• Verification of property titles and ownership documents
• Consultation with legal professionals
• Understanding local property laws and regulations

Any disputes arising from the use of the Platform shall be resolved through:

1. Negotiation: Parties shall first attempt to resolve disputes through good-faith negotiation
2. Mediation: If negotiation fails, disputes shall be submitted to mediation
3. Arbitration: Unresolved disputes shall be settled by arbitration in accordance with the Arbitration and Conciliation Act, Cap A18, Laws of the Federation of Nigeria

Arbitration shall take place in Kano, Nigeria, and the decision shall be final and binding.

Mutual Benefit Premier Properties Ltd reserves the right to terminate or suspend user accounts with 14 days' notice if Terms are violated. Users may terminate their accounts at any time with 7 days' written notice.

Mutual Benefit Premier Properties Ltd shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, government actions, or internet disruptions.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any legal proceedings shall be conducted in the courts of Kano State.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
